Walmart is now facing another class action lawsuit, adding to a string of legal challenges brought against the retailer recently.
The latest complaint says Walmart’s Great Value frozen shrimp contains less product than the packaging suggests because the company allegedly counts the weight of ice glaze in its net weight calculations. The suit claims some bags may contain as much as 11% less shrimp than advertised.
Earlier allegations this year accused Walmart of taking part in a price-fixing scheme involving PepsiCo, overcharging on meat, and selling baby food contaminated with toxic heavy metals. This newest filing says the retailer is misleading shoppers and violating state consumer protection laws through its Great Value packaging.
Frozen shrimp is often covered with an ice glaze to prevent freezer burn, but FDA rules say the weight of frozen water cannot be included in the product’s net weight. The lawsuit argues that Walmart is effectively charging customers for the ice as well as the shrimp.
The complaint says that after thawing and draining, the shrimp does not match the weight listed on the package. It seeks damages, restitution, and an injunction requiring Walmart to stop the alleged mislabeling of its Great Value frozen shrimp, though no specific dollar amount has been stated.
Walmart has 30 calendar days to file a formal response, or 60 days to complete a waiver-of-service agreement.
